General Provisions

1. Respecting the right to privacy of persons who entrusted us with personal data, ENJOY THE CHOICE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw, Sabały 41/20, 02-174 Warsaw entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, Commercial Department of the National Court Register under the number 0000990460, share capital PLN 10,000.00, Tax Identification Number (NIP): 5223235323 declares that it pays special attention to the issue of ensuring the security of personal data processed in connection with the Company’s activities, which is why in this Privacy Policy we inform about the legal basis for processing, types of personal data processed by the Company, their collection and use, as well as the cookies policy applied. This information applies to personal data entrusted to us by all natural persons.

  1. The privacy policy sets out the rules for the collection, use, processing and  protection of personal data of users of the Rosliniak.pl website (hereinafter referred to as the Website), including persons with an account in the online store operated at the above-mentioned address (hereinafter referred to as the Online Store) and purchases made therein, hereinafter referred to as Users.
    3. The privacy policy is divided into the policy of processing personal data and the policy of cookies.

ADMINISTRATOR OF PERSONAL DATA AND OTHER DEFINITIONS

Administrator of Personal Data within the meaning of Art. 4 point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the GDPR), and thus the entity responsible for their processing is: ENJOY THE CHOICE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw, ul. Personal data – this is information about an identified or identifiable natural person (data subject); an identifiable natural person is a person who can be identified directly or indirectly, in particular on the basis of an identifier such as name, identification number, location data, online identifier or one or more specific factors determining the physical, physiological, genetic, mental, economic, cultural or social identity of a natural person.

RODO – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

The Personal Data Controller, which is ROŚLINIAK, in connection with the processing of personal data, ensures compliance with the principles of personal data protection included in the GDPR in its entirety.

Everyone who processes data on behalf of ROŚLINIAK shall exercise special care in order to protect the interests of data subjects by:
– correct downloading of data,
– protection of personal data against unauthorized access,
– protection against destruction, modification or loss of data,– protection of any information media containing personal data against unauthorized access and against accidental destruction.

WHAT DATA IS COLLECTED?

Through the website ROŚLINIAK collects and processes data, including personal data of natural persons related to:

1. making purchases in the Online Store and concluding and implementing the sales agreement, including contact with the User in connection with the order;

2. concluding and implementing the account management agreement in the Online Store;

3. subscribing to the Newsletter and receiving data;

4. agreeing to receive commercial information, including information about news and promotions available in the Online Store and to provide services electronically. 

What IS THE PURPOSE, LEGAL BASIS FOR PROCESSING PERSONAL DATA
Personal data is processed by ROŚLINIAK in the purposes indicated below, based on the following legal grounds:

1. conclusion and implementation of the sales contract, including the delivery of the product, contact in connection with the implementation of the order, handling the purchase transaction, art. 6 1 letter b of the GDPR,

2. creating and maintaining an account in the Online Store, art. 6 1 letter b of the GDPR,

3. keeping accounting books and tax documentation (in the case of concluding a sales contract in the Online Store), art. 6 (1) point c of the GDPR in connection with Article 74 2 of the Accounting Act and other special provisions ,

4.in order to pursue claims and defend against claims for business activity, which is a legitimate interest in the processing of personal data by ROŚLINIAK, art. 6 1 letter f of the GDPR ,

5. in order to send commercial and marketing information, including sending the Newsletter, sending offers, information on promotions, launches of new products and news regarding the Online Store and ROŚLINIAK, art. 6 1 (f) of the GDPR (legitimate interest of ROŚLINIAK, which is the marketing of ROŚLINIAK products and services only in the case of regular customers and natural persons conducting business activity), or pursuant to art. 6 1, Letter a of the GDPR in connection with Article 10 section 2 of the Act on the provision of electronic services and art. 172 item 1 of the Telecommunications Law, i.e. on the basis of the consent given ,

6. in order to create profiles of Users’ preferences aimed at adapting the products and services offered by ROŚLINIAK to the User’s needs, which is the legitimate interest of ROŚLINIAK, art. 6 1 letter a of GDPR and art. 6 1 (f) of the GDPR. 

DATA RECIPIENTS
In connection with the conducted activities of ROŚLINIAK will disclose personal data to the following entities:

1. entities and bodies of state and local government administration authorized by law to receive them, including tax offices, ZUS, in order to comply with the provisions of tax law, accounting regulations, fulfillment of obligations arising from decisions, decisions issued by authorized bodies, institutions or courts,

2. banks in the event of the need to conduct settlements,

3. entities cooperating and supporting ROŚLINIAK in conducting business activities such as: providers of ICT systems, hosting service providers, auditing entities activities, providing accounting and legal services, entities cooperating within marketing campaigns, while such entities will process personal data only for the purpose and to the extent indicated by ROŚLINIAK.

  1. courier companies, Poczta Polska, companies servicing payment transactions.

STORAGE PERIOD OF PERSONAL DATA

In order to maintain the basic principles of personal data processing, including the principles of purposefulness of personal data processing and a limited period of storage, ROŚLINIAK informs that personal data will be stored until:

1. in the case of processing on the basis of consent – until consent is withdrawn;

2. in the event that ROŚLINIAK processes data on the basis of the legitimate interest of the data controller, the processing period lasts until the above-mentioned interest ceases (e.g. the limitation period for civil law claims) or until the data subject objects to further such processing – in situations where such an objection is granted in accordance with the law;

3. in the event that ROŚLINIAK processes personal data because it is necessary due to applicable law, the periods of data processing for this purpose determine these provisions;

4. in the event that ROŚLINIAK processes data in connection with the conclusion, performance of the contract, for the duration of this agreement, unless the law provides for a longer period of data storage, which may be related, for example, to the financial settlement of this agreement, the pursuit of claims for payment or defense against claims. 

LAWFULNESS INTHE SCOPE OF DATA PROCESSING

Persons whose data are processed by ROŚLINIAK have the following rights:
a) The right to information about the processing of personal data:
On this basis, the person submitting such a request, ROŚLINIAK provides information about the processing of data, including in particular the purposes and legal basis for processing, the scope of the data held, the entities to whom they are disclosed and the planned date of their removal;

b) Right of access, including obtaining a copy of the data: On this basis, ROŚLINIAK provides the data subject with a confirmation whether their personal data are processed and, therefore, whether they have the right to access information.
As part of this right, ROŚLINIAK, at the request of a natural person, provides a copy of the data processed regarding the person submitting the request. When dealing with the application of a natural person, ROŚLINIAK analyzes art. 15 of the GDPR and the provisions of other special acts, in order to make its correct decision.

c) Right to rectification:
On this basis, ROŚLINIAK is obliged to remove any incompatibilities or errors of the processed personal data, as well as supplement them, if they are incomplete, at the request of the authorized person and after submitting an appropriate statement and  proving the existing need to rectify the data. The legal basis for the rectification of data is described in Art. 16 of the GDPR.

d) Right to erasure:
On this basis, it is possible to request the erasure of data: the processing of which is no longer necessary for the performance of any of the purposes for which it was collected or otherwise processed; a person whose data was processed pursuant to Article 6 1 letter a – has withdrawn consent to their processing and there is no other consent to its processing; the person whose data is processed raises an objection to its processing and there are no other overriding grounds for processing, unless it concerns direct marketing. The right to delete data is enshrined in Art. 17 of the GDPR, when analyzing the application, ROŚLINIAK is obliged to take into account the conditions excluding the possibility of deleting data specified in art. 17(3) 3 GDPR.



e) Right to restriction of processing:

On this basis, ROŚLINIAK ceases to process personal data if such a request is made, except where the processing is related to storage, only with the consent of the data subject, or for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for important reasons of public interest of the Union or of a Member State. The right to limit processing is specified in art. 18 of the GDPR, which is the basis for the analysis of the implementation of the submitted application. In this case, it is also necessary to analyze art. 19 of the GDPR and its implementation.

f) Right to data portability:
On this basis, to the extent that the data is processed in an exclusively automated manner, in connection with a concluded contract or consent, ROŚLINIAK will issue the data provided by the data subject in a machine-readable format. It is also possible for a natural person to request the transfer of this data to another entity – provided, however, that there are technical possibilities in this respect on the part of both the Administrator and the other entity; The right to transfer data is described in art. 20 of the GDPR and applies only to the processing of data in an automated manner.

g) The right to object to the processing of data.

On this basis, the data subject may at any time object to the processing of personal data for reasons related to his or her particular situation. The objection in this respect should contain a justification. The PDA may continue to process the data if it proves that there are valid legitimate grounds for processing overriding the rights and freedoms of the person who submitted the application. This does not apply to the objection to the processing of data as part of direct marketing, where the processing should be stopped immediately. The rules for examining the objection are contained in Art. 21 of the GDPR. In particular, the User has the right to object to the processing of his personal data if the basis for data processing by ROŚLINIAK is the legitimate legal interest of PDC (art. 6 (1) (f) of the GDPR).
After submitting the objection, the PDC will not be able to process personal data based on the above-mentioned basis of processing, unless it demonstrates the existence of valid, legally justified grounds for data processing, overriding the interests, rights and freedoms of the data subject, or grounds for establishing, pursuing and defending claims.
If ROŚLINIAK processes User’s data for the purposes of direct marketing pursuant to art. 6 1 (f) of the GDPR, the User has the absolute (not limited by the necessity of demonstrating a special situation by the User) right to object to the processing of his data by ROŚLINIAK for direct marketing purposes.

h) Right to withdraw consent:
If the data is processed on the basis of consent, the data subject has the right to withdraw it at any time, which, however, does not affect the lawfulness of the processing carried out before the withdrawal of this consent. When considering the application, it should be remembered that it is necessary to consider the application in terms of the possibility and necessity of further processing of data in connection with the existence of other grounds for processing.

i) Right to complain:
If the data subject considers that the processing of personal data violates the provisions of the GDPR or other provisions on the protection of personal data, he may submit a complaint to the President of the Office for Personal Data Protection in Warsaw.

IS THERE AN OBLIGATION TO PROVIDE DATA

ROŚLINIAK collects personal data directly from the User. Providing data by the User:

1) necessary to perform the sales contract is voluntary, but it is a condition for concluding the sales contract; refusal to provide them (if necessary) will result in the inability to make a purchase in the Online Store or issue an invoice;

2) necessary to set up an account in the Online Store is voluntary, but it is a condition for setting up and maintaining an account in the Online Store; refusal to provide data will result in the inability to set up an account in the Online Store;

3) collecting data necessary to send commercial and marketing information, including the newsletter is voluntary, but necessary to receive commercial information; refusal to provide data will result in the inability of ROŚLINIAK to
send commercial and marketing information, including the newsletter.

PRODUCTION OF DATA IN AN AUTOMATED MANNER

Personal data will not be processed in an exclusively automated manner, including through profiling, in such a way that as a result of such automated processing any decisions could be made, other legal effects would be caused or otherwise it would significantly affect our customers, contractors and their employees/associates. 

PRODUCTION OF DATA TO THE THIRD COUNTRY

Personal data will not be transferred to a third country.

The website https:// Rośliniak.pl does not automatically collect any information, except for the information contained in cookies.

 Cookies (so-called “cookies”) are IT data, in particular text files, which are stored on the

Website User’s end device and are intended for use on the Website. Cookies usually contain the name of the website from which they originate, their storage time on the end device and a unique number.

The entity placing cookies on the Website User’s end device and accessing them is ROŚLINIAK.

Cookies are used to:

– adapt the content of the Website to the User’s preferences and optimize the use of the Website; in particular, these files allow to recognize the Website User’s device and properly display the Website, tailored to their individual needs;
